Do I Have To Go To Court To Get A Divorce?

Everyone seems intimidated by the court process and this is a frequently asked question. Court, in addition to its menacing image is also unpredictable, expensive and unfamiliar to most of us. All of which leads you back to how uncomfortable the thought of going to court really is.

The short answer to the question is not really. All divorce cases do need to be approved by the court so in order to have a divorce you do need the sanction of a court. If both parties (you and your spouse) agree to the terms of the divorce agreement, the judge considers the agreement reasonable under the applicable state law, and  the agreement was arrived upon without duress, then you will spend more time waiting for the judge then being heard by him/her. In short, about 5-10 minutes. In fact only about 2% of all divorce cases go to court in the U.S.
